These Terms of Service ("Terms") govern your use of ProofStream's website, services, and related offerings. By accessing or using ProofStream's services, you agree to be bound by these Terms in their entirety.
By accessing and using the ProofStream website and services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you may not use our services. ProofStream LLC reserves the right to modify these Terms at any time with notice. Continued use of the service after modifications constitute acceptance of the revised Terms.
ProofStream provides in-person, human-performed verification services conducted at specified locations. Our services include optional live-streamed video documentation of the verification process. ProofStream does not provide legal opinions, professional appraisals, certifications, authenticity guarantees, insurance assessments, or any form of guarantee or warranty regarding the items, property, or documents verified. Our services are limited to visual documentation, human observation, and written reporting of what is observed during the verification process.
ProofStream offers three primary service tiers:

To request a verification service: (1) Submit a detailed service request via our online form, including item/property description, location, and any specific requirements; (2) Receive a quote and service estimate; (3) Approve the quote and authorize payment; (4) Upon payment confirmation, ProofStream will dispatch a verifier to conduct the service. Customers remain responsible for ensuring legal access to the verification location and notifying ProofStream of any access restrictions.
All prices are listed in United States Dollars (USD) and are subject to change with notice. Payments are processed securely via Stripe and are non-refundable except as expressly stated in the Cancellation and Refunds section. Additional charges, including rush service fees and same-day service surcharges, may apply and will be disclosed prior to payment. By submitting payment, you authorize ProofStream to charge the payment method provided. ProofStream is not responsible for declined payments or insufficient funds.
Livestreamed verification is an optional add-on service available for an additional fee. Livestream availability depends on stable internet connectivity at the verification location. ProofStream is not responsible for connectivity issues, buffering, stream interruptions, signal loss, or service unavailability due to internet or environmental factors. Livestreams are not recorded by default; recorded streams are available upon request for an additional fee and will be provided via secure delivery. Customers may not redistribute, rebroadcast, or republish livestream content without written permission. Livestream audio and video quality may vary based on conditions at the verification site.
All stated turnaround times are estimates and not guaranteed delivery times. Actual delivery may be extended due to location accessibility, scheduling conflicts, verifier availability, verification complexity, or unforeseen circumstances. ProofStream will make reasonable efforts to meet stated timelines but makes no binding commitment to deliver within any specific timeframe. Customers requiring time-sensitive verification should communicate urgency at the time of request and may be eligible for rush processing fees.
Upon completion of verification, ProofStream delivers: (1) Timestamped photo reports organized by category; (2) Written findings summarizing observations, conditions, and relevant details; (3) Any requested supplementary documentation. All deliverables are provided electronically via secure download or email. ProofStream makes reasonable efforts to ensure accuracy and completeness of reports, but does not guarantee error-free or comprehensive documentation. Customers are responsible for reviewing deliverables and flagging any errors within 7 days of receipt.
ProofStream provides visual documentation and human observation only. Our services explicitly do not include:
For professional opinions in these areas, customers must engage appropriately licensed professionals such as attorneys, appraisers, engineers, or forensic specialists.
ProofStream's total liability for any claim, loss, or damage arising from the use of its services shall not exceed the amount paid by the customer for the specific service in question. In no event shall ProofStream be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost revenue, loss of business opportunity, or reputational harm, even if advised of the possibility of such damages. ProofStream is not liable for decisions, transactions, or actions made by customers, third parties, or any other entity based on or relying upon verification reports or findings.
ProofStream services are provided "as is" and "as available" without any warranties, express or implied. ProofStream expressly disclaims all warranties including but not limited to:
Customers use ProofStream services at their own risk and assume all responsibility for decisions made based on verification reports.
Refund policy is as follows:
Cancellation requests must be submitted in writing to verify@proofstream.ai. Rescheduling is available for up to 24 hours before the scheduled verification time at no additional charge (subject to verifier availability). Rescheduling beyond 24 hours may result in rescheduling fees or loss of deposit.
Customers retain ownership of their verification reports and deliverables, including photographs, written findings, and related documentation. Customers may use these deliverables for personal, business, or legal purposes. ProofStream retains all rights to anonymized verification process data, methodologies, operational improvements, and aggregated insights derived from services provided. The ProofStream name, logo, and all associated branding materials are trademarks of ProofStream LLC and may not be used without written permission. Customers may not reverse-engineer, modify, or reproduce ProofStream's processes or systems.

Violation of these obligations may result in service termination, legal action, and/or referral to law enforcement if warranted.
ProofStream collects and processes personal data in accordance with our Privacy Policy. Please refer to our Privacy Policy for detailed information about data collection, use, retention, and your privacy rights. By using ProofStream services, you consent to the data practices described in our Privacy Policy. If you do not agree with our privacy practices, do not use our services.
Customers agree to indemnify, defend, and hold harmless ProofStream LLC, its officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (1) the customer's use of ProofStream services; (2) customer's violation of these Terms; (3) customer's violation of any applicable law or regulation; (4) false or misleading information provided by the customer; (5) customer's unauthorized use of verification reports; or (6) claims by third parties arising from customer's use of ProofStream services.
Any dispute arising from these Terms or ProofStream services shall first be subject to good faith negotiation between the parties. If negotiation fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Wilmington, Delaware. Each party shall bear its own costs, with arbitration fees split equally unless the arbitrator determines otherwise. Customers retain the right to pursue claims in small claims court if the dispute qualifies. Customers waive the right to participate in class action lawsuits or class arbitrations against ProofStream.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. The parties consent to exclusive jurisdiction in the state and federal courts located in Delaware for resolution of disputes not subject to arbitration.
ProofStream shall not be liable for delays, failures, or inability to perform services due to events beyond its reasonable control, including but not limited to: acts of God, natural disasters, severe weather, pandemics, government actions, war, terrorism, labor strikes, utility failures, or catastrophic system failures. In such circumstances, ProofStream will make reasonable efforts to reschedule services or issue refunds per the Cancellation and Refunds policy.
Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be reformed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between the customer and ProofStream regarding the use of services and supersede all prior agreements, understandings, and representations.
No Waiver: The failure of ProofStream to enforce any right or provision shall not constitute a waiver of that right or provision.
Assignment: Customers may not assign or transfer these Terms or their rights hereunder without ProofStream's written consent. ProofStream may assign these Terms to affiliates or successors.
Amendments: ProofStream reserves the right to modify these Terms at any time. Customers will be notified of material changes via email or prominent notice on the website. Continued use following notice constitutes acceptance of revised Terms.
